State dismisses rape case

The state has dismissed a case against a man charged with raping a minor.

Joe Don Winningham, attorney for James Paul Maxell, said he was notified May 10 that the state decided to nol prosse the case.

According to a motion filed in Van Buren County Circuit Court, the state moved to drop the case citing “insufficient evidence upon which to proceed to trial.”

Maxwell, 45, was charged in 2011 with the offense.

In other Circuit Court action, Chad Eric Wall, 39, was sentenced Thursday to 72 months in the Arkansas Department of Correction on theft of property and residential burglary charges. He also received 48 months suspended imposition of sentence.

Chad M. Walton was sentenced to six months in the county jail and 36 months suspended imposition of sentence. He was charged with false imprisonment-second degree and domestic battering-third degree.

James Neil Scott, charged with possession of firearms by certain persons, received a 36-month suspended sentence.

Other cases from Thursday’s court date were rescheduled.
