Rape cases continued until January

A rape case has been transfered to a different division and continued until next year.

Tyler Wayne Delk, 23, faces a charge of rape, a Class Y felony. His case has been transferred from Division 1 to Division 3 in Circuit Court. Division 1 is currently handled by Judge David Reynolds, who is leaving the Circuit Court bench at the end of the year and will become a District judge. H.G. Foster, a former prosecutor, has been appointed to fill the rest of Reynolds’ term, but Foster will handle mostly civil cases.

Delk’s case will not be in Division 3, which is Judge Charles Clawson’s division. The case has been continued until Jan. 29, 2013.

Also in Circuit Court:

• A pretrial hearing has been scheduled for Jan. 29, 2013, for David Ray Cook. Among charges Cook is facing are rape, a Class Y felony, possession of matter depicting child sex, maintaining a drug premises, manufacture, delivery and possession of a controlled substance.

• Tiffany Cooley, charged with possession of drug paraphernalia, was sentenced to 24 months probation.

• Mitchell Kirkendoll, who had been charged with possession of firearms by certain persons, terroristic threatening, and probation violations, was sentenced to 12 months in the county jail, with 24 months and 30 days suspended. He also was fined $220.
